Radiant Roof Repairs Pty Ltd — Terms and Conditions
These Terms and Conditions (“Terms”) apply to all work carried out by Radiant Roof Repairs Pty Ltd (“Radiant Roof Repairs”, “we”, “our”, “us”) for any customer (“Client”, “you”, “your”). By accepting a quotation, paying a deposit, or permitting work to commence, the Client agrees to be bound by these Terms.
1. Scope of Work
Radiant Roof Repairs agrees to perform the work described in the accepted quotation in a professional and workmanlike manner and in accordance with:
The National Construction Code (NCC),
Australian Standards (AS 2050: Installation of Roof Tiles, AS/NZS 1562.1: Metal Roofing), and
Relevant manufacturer specifications.
Unless otherwise specified, the quotation applies only to the works described and excludes latent or unforeseen conditions.
2. Materials and Workmanship
All materials supplied will be new and suitable for their intended purpose unless otherwise stated.
Where materials become unavailable, Radiant Roof Repairs reserves the right to supply equivalent products of equal or greater quality.
Work will be completed diligently and within a reasonable timeframe, subject to weather, site conditions, material availability, and other external factors beyond our control.
Work cannot be safely performed during adverse weather such as rain or high winds.
3. Delays and Force Majeure
Radiant Roof Repairs is not liable for delays or failure to complete work caused by factors outside our control, including:
Weather conditions, illness, injury, supplier delays, or site inaccessibility;
Council or third-party interference; or
Safety hazards discovered during work.
Delays will be communicated promptly and the schedule adjusted as necessary.
4. Pricing and Variations
All quotations are valid for 30 days from the date of issue.
The quoted price covers only the specific works described. Any additional work, unforeseen conditions, or scope changes must be approved in writing as a formal variation before proceeding.
All prices include materials, labour, travel, insurance, and administration unless otherwise stated.
Variations requested by the Client will be invoiced separately and must be accepted in writing prior to commencement.
5. Cancellations and Scheduling
A minimum of 14 days’ written notice is required for cancellation or rescheduling of accepted works.
Cancellations within 14 days of the scheduled start date may incur charges for:
Materials ordered,
Equipment hire, and
Labour or scheduling costs.
Deposits are non-refundable once materials have been ordered or work has commenced.
6. Warranty
Radiant Roof Repairs Pty Ltd provides warranties on workmanship as outlined below. These warranties are designed to ensure fair protection for both parties while recognising the limitations of roofing systems and the variables outside of our control.
a) New Roof and Restoration Works
All new roof installations and full roof restorations are covered by a 10-year workmanship warranty from the date of completion, provided the roof has been properly maintained as per industry standards.
This warranty covers only the workmanship directly performed by Radiant Roof Repairs.
Paint, coating, and membrane systems are covered only to the extent of the manufacturer’s product warranty, subject to correct maintenance, cleaning, and environmental exposure conditions.
Warranty coverage does not extend to fading, chalking, discolouration, or deterioration caused by UV exposure, pollution, salt air, or chemical cleaning agents.
b) Repair Works
All repair work (including repointing, tile replacement, flashing, and leak repairs) is covered by a 12-month workmanship warranty from the completion date, limited strictly to the specific repair area.
If a leak recurs within this period in the same location and due to the same cause, Radiant Roof Repairs will attend and rectify the issue at no cost.
The warranty does not apply if the leak results from a new, unrelated issue, structural movement, improper maintenance, or interference by others.
c) Warranty Exclusions
This warranty is void and Radiant Roof Repairs accepts no liability in the following circumstances:
Third-party interference: Any work, repairs, or installations by other trades, including but not limited to solar panel installers, electricians, plumbers, or antenna technicians.
Foot traffic or damage: Any damage caused by walking, climbing, or loading items on the roof after completion.
Storm or natural disaster: Damage from wind, hail, flood, tree impact, or any other natural event beyond our control.
Lack of maintenance: Failure to keep gutters, valleys, or downpipes clean, or failure to maintain the roof in accordance with standard maintenance practices.
Structural movement or settlement: Any cracking, shifting, or movement in the roof frame or structure.
Water ingress from unrelated areas: Including flashing, skylights, box gutters, or adjoining structures not part of the quoted works.
Design or material limitations: Roof pitch, product suitability, or installation defects from previous trades that restrict full compliance with current NCC or AS 2050 standards.
Environmental exposure: Rust, corrosion, or coating breakdown due to environmental factors such as salt air, pollution, or chemical exposure.
Warranty Exclusions and Limitations
The warranty provided by Radiant Roof Repairs Pty Ltd is subject to the following exclusions and limitations:
Third-Party Interference or Access
This warranty will be immediately void if any person, contractor, or third party other than Radiant Roof Repairs Pty Ltd or its authorised representatives accesses, walks on, alters, repairs, installs, or interferes with any part of the roof or roof coatings following completion of the works.
This includes but is not limited to:Builders, solar installers, antenna or satellite technicians, air-conditioning trades, cleaners, or pest control operators accessing the roof;
Any person stepping on or walking over roof tiles, flashing, or coatings, regardless of whether visible damage occurs.
Subsequent Damage
The warranty does not cover damage resulting from:Physical impact, walking on tiles or flashings, or disturbance of pointing, coatings, or sealants;
Alterations to the roof structure, penetrations, or installation of additional fixtures after completion;
Improper maintenance, neglect, or blockage of gutters, valleys, or downpipes.
Client Responsibility
Clients are responsible for ensuring that no unauthorised access occurs after project completion.
Any future roof access by other trades must be approved in writing by Radiant Roof Repairs Pty Ltd, who reserves the right to inspect the roof post-access to reinstate warranty coverage if applicable (service fees may apply).
d) Warranty Conditions
The Client must notify Radiant Roof Repairs in writing within 14 days of discovering any potential defect or leak.
Radiant Roof Repairs reserves the right to inspect the site before any other party performs remedial work.
Any third-party intervention before our inspection automatically voids the warranty.
The Client must provide safe access to the roof for inspection and rectification works.
If a warranty claim is found to be unrelated to our work or caused by one of the exclusions above, a service call-out fee of $250 (incl. GST) will apply.
e) Limit of Liability
To the maximum extent permitted by law:
Radiant Roof Repairs’ liability under this warranty is strictly limited to the cost of the original works performed.
We are not liable for any consequential or secondary damage, including but not limited to:
Internal ceiling or wall damage,
Electrical or water damage to fixtures or contents, or
Loss of income, rental, or amenity.
Our responsibility is limited solely to repairing or refunding the cost of the defective work, as determined at Radiant Roof Repairs’ discretion.
This warranty is not transferable to subsequent property owners unless expressly agreed in writing.
f) Maintenance Requirements
To maintain warranty validity, the Client must:
Have the roof inspected and gutters cleaned at least every 12 months.
Avoid use of high-pressure cleaners, harsh chemicals, or abrasive tools on the roof surface.
Ensure no structural alterations, penetrations, or installations are performed without consultation with Radiant Roof Repairs.
Failure to maintain the roof in accordance with these requirements will void the warranty.
g) Warranty Remedy
Where a valid warranty claim is made:
Radiant Roof Repairs will, at its sole discretion:
Repair or re-perform the defective work; or
Refund the original invoiced value of the specific item of work.
Radiant Roof Repairs reserves the right to refund monies for works completed instead of performing further repairs if deemed unviable by an estimator.
No cash compensation, consequential damages, or third-party costs will be reimbursed.
7. Client Obligations
Provide safe and reasonable access to the site, including removal of obstacles such as vehicles or garden items.
Notify Radiant Roof Repairs of known hazards (e.g. asbestos, electrical hazards, structural instability).
Secure pets and inform tenants, neighbours, or residents of scheduled work.
Ensure adequate access for equipment and trades.
Delays caused by access or site readiness issues may incur additional charges.
Radiant Roof Repairs is not responsible for:
Driveway or landscaping damage from equipment,
Overspray or dust where protective measures were declined, or
Damage caused by pre-existing structural or design issues.
8. Exclusions
Unless expressly stated, the quotation excludes:
Structural carpentry or replacement of framing/battens,
Asbestos removal or disposal,
Electrical, insulation, or internal ceiling repairs,
Council permits or engineering certifications, and
Water ingress caused by areas not included in the quoted works.
9. Right to Withdraw
Radiant Roof Repairs reserves the right to withdraw from any agreement prior to commencement of works. Any deposits paid will be refunded in full in such cases.
10. Payment Terms
Payment is due upon completion of works, unless otherwise agreed in writing.
For works up to $10,000 (incl. GST):
30% deposit upon acceptance;
Balance upon completion.
For works over $10,000 (incl. GST):
30% deposit upon acceptance,
25% progress payment once 50% of the work is complete,
Balance upon completion.
Overdue invoices may incur interest at 2.5% per month, plus reasonable recovery and legal costs.
All materials remain the property of Radiant Roof Repairs until full payment is received.
11. Ownership and Risk
Ownership of materials transfers to the Client only after payment in full. Risk in the goods passes upon installation.
12. Limitation of Liability
To the maximum extent permitted by law:
Radiant Roof Repairs’ liability is limited to the contract value of the works performed.
We are not liable for consequential losses, including property damage, internal leaks, or financial loss.
The Client agrees that any claims must be made in writing within 14 days of discovering the issue.
13. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved under the exclusive jurisdiction of the courts of Queensland.
14. Acceptance
By accepting a quotation, paying a deposit, or allowing work to commence, the Client acknowledges they have read, understood, and agreed to these Terms & Conditions in full.
Radiant Roof Repairs Pty Ltd Terms and Conditions
Radiant Roof Repairs Pty Ltd ("Radiant Roof Repairs" hereafter) aims to perform the work described in this quotation in a professional and workmanlike manner and in accordance with the plans and specifications.
All materials supplied by Radiant Roof Repairs are intended to be suitable for the purpose for which they will be used and, unless otherwise stated in the quotation, those materials will be new.
The work will be done with due diligence and is aimed to be completed within a reasonable timeframe, subject to external factors such as weather and supply delays.
Work may be delayed due to unforeseen circumstances, including but not limited to weather conditions, supply chain issues, and personnel availability. Radiant Roof Repairs will communicate any delays and adjust the schedule as necessary.
Specific conditions like rainy days may delay the commencement of work, as work cannot be carried out on rainy days due to OH&S regulations. Examples of work that cannot be done on rainy days include re-bedding and re-pointing work, and colour application.
In case of delays due to illness, injury, material supplies delays, or council work, Radiant Roof Repairs will make every effort to keep clients informed and maintain the work schedule. Emergency work required for safety hazards will take precedence over other scheduled work.
Regarding price: The quoted price is based on the estimated time and may be subject to adjustment only in cases of significant unforeseen changes in scope or duration of work, as agreed upon in writing.
Radiant Roof Repairs Contractors may not do additional work other than the approved quotation unless instructed by management and only then in accordance with an additional written and duly accepted quotation amendment or variation to the original quote.
This is a fixed quotation and is not negotiable after commencement of any works.
All quotes and deposits are to be made within the terms outlined. If you choose to cancel or modify your quote we require minimum 2 weeks' notice via email. There is no cancellation fee at this point; however, less than 2 weeks' notice will result in billing for all costs incurred up to that point, including:
Ordering of materials
Hiring of and supplying equipment
Labour Cost
Our Warranty:
a) All New Work is Warrantied for 10 Years unless otherwise stated on the quotation. (The Warranty is in force once the work has been completed).
Leaking in roofs is covered under the 10-year guarantee only if it occurs within the first 6 months for New Work. The warranty covers coatings only and is limited to the product manufacturer's specifications. Warranty on coatings for Asbestos roofs will be specified.
b) Repair work is guaranteed for 12 months against re-leaking in the same area, unless otherwise stated in the quotation. While we strive for first-time success, additional attendances/repairs may be necessary. Re-attendance within the 12-month period to fix a recurring leak in the same area will be without charge, but Radiant Roof Repairs will not be liable for property damage caused by the leak.
c) In the event that a Warranty call-out is due to a cause unrelated to our work or due to damage by others, a call-out charge of $250 (inc. GST) will apply.
d) Radiant Roof Repairs reserves the right to refund monies for works completed instead of performing further repairs if deemed unviable by an estimator.
e) All warranties are limited to a full refund of the cost of the work completed.
Client's Obligation:
Clients (landlords, agents, etc.) must identify hazards to the supervisor, such as hazardous chemicals, electrical and plumbing service problems, asbestos, and concurrent work.
Clients must notify parties affected by the work (e.g., neighbours, tenants) and ensure access to the property by removing or covering items like cars or motorbikes. Radiant Roof Repairs is not responsible for damages if property has not been removed or covered. Charges may apply if work is delayed due to access issues like locked gates or obstructed driveways.
Radiant Roof Repairs is not liable or responsible for any damage to the property, driveway, or surrounding environment caused by the use of hired equipment during the course of the work.
Clients should also inform Radiant Roof Repairs of any site changes that occurred since the quotation, such as additional roof work or potential damage causes.
Client Property/Pets:
It is the client's responsibility to manage pets and other animals during work, as workers will need access through gates. We recommend securing pets to prevent escape or distress due to noise.
Clients are advised to move or cover valuable outdoor items to protect them from damage during work.
Exclusions:
The quotation excludes latent conditions and events not stated in the quotation.
Right to Withdraw:
Radiant Roof Repairs reserves the right to withdraw from this contract prior to commencement of works, with any deposit monies received to be refunded forthwith.
Payment Terms:
Full payment is due upon completion of works, unless otherwise agreed in writing. For works up to $10,000 (incl GST), a 25% deposit is required upon acceptance, with the balance upon completion. For works over $10,000, a 30% deposit is due upon acceptance, 25% once 50% of the job is complete, and the balance upon completion.
